Guidelines for Access to IHP Digitalized Collections and Resources

  • I. Purposes
  • The purpose of these guidelines is to establish a management mechanism for accessibility to Institute of History and Philology (IHP), Academia Sinica, digitalized collections and resources, encompassing the catalogs, full texts, images, and other digital resources developed and made available online by the IHP.
  • II. Access Policy
    • Access to online databases is limited to within Taiwan; access for those outside of Taiwan is restricted, mainly limited to scholarly and resource exchange with participating academic institutions, and is not open for personal use.
    • Digital image files are divided into three classifications: public information, commercial, and collections. The resolution, quality, and size of images in each classification are determined by the management of each respective database.
    • Authorization is not required for the use of online catalogue-type databases (including thumbnails). For online full-text and image databases, however, authorization, methods of browsing, and printing fees are all determined by the management of each respective database.
    • Online catalogue-type databases only provide thumbnails, the resolution and size of which, as a general rule, is between 72–150 DPI and does not exceed 500x500 pixels, respectively.
    • When being viewed or printed, digital images provided by online full-text and image databases as well as digital image files must be clearly marked with a prominent watermark or text in a manner that indicates the management rights of the IHP.
    • For research purposes, IHP colleagues may apply for electronic copies of full texts in accordance with “Guidelines for the Internal Use of IHP Cultural Artifacts, Documents, and Other Digital Materials” 本所文物圖書數位資料內部使用要點. Applicants are also required to sign a guarantee of use. Applicants requesting digital image files classified as “commercial” or “collections,” however, must first submit a license application.
    • For teaching or research purposes, individuals and academic institutions, whether domestic or foreign, unaffiliated with the IHP may apply for electronic copies of full texts in accordance with “License Application Guidelines for Individuals Unaffiliated with the IHP for the Use of IHP Images and Other Materials.” Applicants are also required to sign a guarantee of use. Applicants requesting digital image files, regardless of classification, must first submit a license application.
    • For purposes of value-added research and development, commercial entities, whether domestic or foreign, may only apply for digital image files classified as “commercial” or lower in accordance with “License Application Guidelines for Individuals Unaffiliated with the IHP for the Use of IHP Images and Other Materials.” In instances of co-publishing or similar projects, a separate cooperation agreement shall be drawn up by all involved parties.
    • Electronic copies of full texts and digital image files applied for in accordance with the above items 6. and 7. of “Access Policy” shall be handled by the management mechanism of the IHP, including the processing of authorization and licensing, and are protected by the Copyright Law of the Republic of China.
    • Fees for requested items applied for in accordance with the above items 6., 7., and 8. of “Access Policy,” unless otherwise specified, shall be charged in accordance with the regulations in “Details of Fees and Charges for Using IHP Collections.”
  • III. Authorization for use by IHP research fellows and collections management for purposes of specific projects shall be reported in advance, and following approval by the director of the IHP, are not bound by point 2 (“Access Policy”) of these guidelines. IHP research fellows and/or collections management shall appoint specific personnel to document in detail and manage the contents of said authorization.
  • IV. The above guidelines have been implemented following approval by the Plenary IHP Council; the same applies to revisions.

License Application Guidelines for Individuals Unaffiliated with the IHP for the Use of IHP Images and Other Materials

    • The following guidelines have been established to meet the needs of individuals unaffiliated with the Institute of History and Philology (IHP), Academia Sinica, in applying for the use of images and other materials of IHP collections.
    • The images and other materials referred to within these guidelines include both traditional media, such as photographs, positive film, etc., as well as digital materials.
    • For applications submitted by individuals unaffiliated with the IHP, if the requested images and other materials have been digitized, the currently existing digital productions or reproductions are, as a general rule, provided. If the specifications, formatting, etc. of the requested items do not meet the applicant’s requirements concerning image quality, separate discussions may be held on how best to produce said item. Additional production or material fees may be charged in accordance with IHP regulations.
    • Digital materials provided by the IHP must first be digitally watermarked or marked with text in a manner that clearly indicates the management rights of the IHP.
    • Applicants who are domestic or foreign academic institutions, individuals, or other public welfare entities requesting the licensed use of images and other materials for the purpose of non-profit research, teaching, academic publications, or other related social education and public welfare activities are required to first submit an application form. After approved by the IHP, applicants must comply with both production and licensing fees of requested items in accordance with IHP regulations. Depending on the purpose for the use of requested items, production fees may only be charged or be waived.
      Applicants who are applying for the purpose of lectures, presentations, or other public uses, are required to comply with publishing guidelines as well as academic citation and acknowledgement practices in accordance with IHP regulations.
    • Applicants who are individuals or entities requesting the licensed use of images and other materials for for-profit purposes are required to first submit an application form. After approved by the IHP, applicants must comply with production and licensing fees of requested items in accordance with IHP regulations as well as all IHP bylaws concerning publishing.
    • For applications submitted by local individuals or entities requesting the licensed use of cultural artifacts of which they were involved in the unearthing and/or collecting, depending on the purpose for the use of said items, only production fees shall be charged.
    • Applications for the licensed use of images and other materials require the following information in detail:
      • The name of the individual or entity requesting licensed use, name of the individual submitting the application, and contact information.
      • The requested items, their quantities, and sources of their information.
      • The purpose(s) for the use of the requested items.
    • When publishing the images and other materials of IHP collections, applicants are required to credit the IHP by including “Courtesy of the Institute of History and Philology, Academia Sinica” or 中央研究院歷史語言研究所藏. Applicants are also invited to give copies of the publications to the IHP.
    • The standards for the calculation of fees for the licensed use of images and other materials are determined by the manager of general affairs and implemented following approval by the director of the IHP; the same applies to revisions.
    • The IHP shall, in accordance with its own situational assessments, exercise its right of approval regarding the type, resolution, quantity, and delivery time of images and other materials of IHP collections.
    • Applicants may only apply once for the licensed use of each requested cultural artifact, document, etc., licensing which may not be transferred to other parties. If the purpose specified in the original application needs to be changed or if another use is needed, applicants must first obtain IHP approval.
    • If any of the following circumstances occur during the applicant’s use of the images and other materials, the IHP has the right to terminate the applicant’s approved license. Additionally, any fees paid by the applicant will not be refunded, and for a two-year period, the applicant will not be allowed to reapply for the licensed use of images and other materials.
      • Actual use is not consistent with the use as specified in the original application.
      • Unauthorized transfer of the license to another party for use without IHP approval.
      • The use of images and other materials without properly indicating the source of said items by crediting the IHP.
      • Any other fact or action that sufficiently harms the rights or benefits of the IHP.

      If the applicant engages in any of the foregoing, thereby infringing upon the rights or benefits of the IHP, the IHP may pursue compensation from the applicant. The same applies if the applicant is responsible, whether intentionally or unintentionally, for any infringement caused by another party.
    • The IHP may claim damages and pursue compensation for any unlicensed or unapproved use of images and other materials of IHP collections or pirated publications.
    • The above guidelines have been implemented following approval by the Plenary IHP Council; the same applies to revisions.
Details of Fees and Charges for Using IHP Collections
  • In order to serve the purposes of cultural promotion and public education, as well as being in line with both Article 21 of the Law for the Development of the Cultural and Creative Industries and “License Application Guidelines for Individuals Unaffiliated with the IHP for the Use of IHP Images and Other Materials,” fees for using the images and other materials owned by the IHP are listed as follows:

    • The fees and charges in this table include the licensing fees and material fees for the use of IHP images, audio or video files, and 3D models. For materials that have yet to be digitized, applicants shall be subject to an additional digitization fee.
    • Subjects of licensing include all images and books, historical materials, artifacts within collections as well as audio and video files owned by the IHP. For items designated by the Ministry of Culture as a “national treasure” under the Cultural Heritage Preservation Act, the licensing fee shall be tripled; for those designated as a “significant antiquity,” the licensing fee shall be doubled.
    • Licensing fees are calculated on a per sheet basis and are valid for one-time usage only. Usage of the licensed subject in different language versions of the same work, publication, exhibition, etc. and in reprints fall under “one-time usage” and are thereby permitted.
    • Table of Fee and Charges for nonprofit individuals, institutions, or organizations (for licensed subjects used abroad, licensing fees shall be calculated in US$):

Material fees include production and processing fees. Ex. of material fees calculation: Applicants applying for the licensed use of 3 sheets, which falls within the range of 1–5, shall be charged a total material fee of US$15; those applying for 7 sheets, within 6–10, shall be charged a total material fee of US$20; and so forth.
      2. If the size of the image of the item applied for exceeds A2 or is of special dimensions, the calculation of the number of sheets shall be determined by the IHP.
      Textbooks, eBooks, series, popular editions, guidebooks, advertising materials, exhibition installations, electronic media (e.g., CDs, websites, videocasts), etc. Domestic:Licensing fee is NT$300 per sheet Abroad:Licensing fee is US$15 per sheet If the size of the image of the item applied for exceeds A2 or is of special dimensions, the calculation of the number of sheets shall be determined by the IHP.
      Audio and Visual Files (namely made using the IHP’s collections, images, or exhibition spaces) eBooks, exhibition installations, videos, electronic media (e.g., CDs, websites, videocasts), etc. Domestic: NT$300 per unit Abroad: US$15 per unit A unit is 15 minutes; the fee for any item under 15 minutes shall be calculated as one unit.
      Audio and Visual Files (namely produced and owned by the IHP) Domestic: NT$300 per unit Abroad: US$15 per unit A unit is 30 minutes; the fee for any item under 30 minutes shall be calculated as one unit.
      3D Models (namely produced and owned by the IHP) Domestic: NT$5,000 per item Abroad: US$200 per item Applications are limited to organizations and groups.
    • Licensing fees for for-profit individuals, institutions, or organizations: 3x (three times) the standard rate as listed in the above Table of Fee and Charges; for-profit organizations or groups applying for use of 3D models must enter into a separate agreement with IHP to be approved regarding usage regulations and licensing fees.
    • For materials that have yet to be digitized, applicants shall be subject to an additional digitization/material fee:
      • Image files: NT$50/US$5 per sheet.
      • 3D Models: NT$2,500/US$100 per day, minimum 2 days. For projects exceeding 2 working days, fees shall be calculated based on actual working days.
        Ex. of calculation: Creating a new 3D model of an artifact requires 3 days, which would then be subject to an additional fee of NT$7,500 (or US$300 for those abroad).
    • Licensing fees will be waived for official (the IHP or Academia Sinica) usage by employees of Academia Sinica and for nonprofit usage by government agencies (including state-run enterprises) or institutions/organizations partnered with the IHP.

      Note:
      • For categories of subjects not specified in the above table, licensing fees shall be calculated in accordance with similar items. Unless otherwise specified, all fees should be paid in NT$. Prices in US$ may be converted into NT$ using the exchange rate at the time. A processing fee of US$20 will be applicable for international wires and money transfers.
      • The IHP shall only proceed with image, audio and visual, or 3d model file output after licensing fees have been paid within the agreed upon time period. Unless otherwise specified and arranged on case basis, provided files are only available in digital formats.
      • When citing images or other materials, applicants agree to credit the IHP within a citation either next to the image or in another place deemed appropriate by including the text “Courtesy of the Institute of History and Philology, Academia Sinica” or 中央研究院歷史語言研究所藏. For applications in compliance with the Creative Commons license (CC BY-NC-ND 3.0 TW), applicants likewise agree to credit the IHP within a citation.
      • Applications meeting the conditions listed in items 5. and 7. of “License Application Guidelines for Individuals Unaffiliated with the IHP for the Use of IHP Images and Other Materials” will only be subject to material fees.
      • Nonprofit usage refers to government publications or productions for cultural and/or educational purposes. Productions of this kind should not be for sale and should not be priced. The IHP reserves the sole right in determining whether a production is for nonprofit or for-profit usage.
      • If an audio or video file is to be made using the IHP’s collections, images, or exhibition spaces, two copies of the final production must be provided to the IHP for storage and reference. The applicant also agrees to give the IHP the right to broadcast and reproduce the file for non-commercial purposes.
      • If the applicant is in violation of item 13. of “License Application Guidelines for Individuals Unaffiliated with the IHP for the Use of IHP Images and Other Materials,” the IHP may pursue additional compensation from 100% to 600% of the original licensing fee.
